Introduction
These Terms of Service (“Terms”) govern access to and use of the Theta Dynamics platform, website, and services (“Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
Theta Dynamics Ltd (“Theta Dynamics”, “we”, “us”, “our”) provides an AI-driven operational-intelligence platform designed for business use only. You represent that you are acting on behalf of a business entity and are authorised to bind that organisation to these Terms. The Services are not directed at individuals acting in a personal capacity, and we do not knowingly collect data from such individuals.
Theta Dynamics acts as the Data Controller for personal data processed through its platform and website. Our registered offices are in the United Kingdom and the United Arab Emirates (Dubai).
Accounts & acceptable use
To use the platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
- Use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
- Do not misuse the platform, attempt unauthorised access, introduce malicious code, or interfere with system integrity.
- Do not use the Services in any way that could damage, disable, or impair their operation or security.
Data we process
In delivering the Services, we process the following categories of data:
Business contact data
Name, work email, phone number, job title, and company name.
Account data
Login details and access logs.
Operational data
Files and reports your organisation uploads for analysis.
Technical data
IP address and device information.
Communication records
Emails and support tickets.
Personal data is processed under lawful bases defined by UK GDPR — performance of a contract, legitimate interests (such as security and service improvement), compliance with legal obligations, and consent where required (particularly for marketing and non-essential cookies).
AI & automated processing
Theta Dynamics uses AI and machine learning to analyse operational data, generate insights, detect inefficiencies, and produce reports. We do not make solely automated decisions that produce legal or similarly significant effects on individuals without human involvement.
We do not use client-uploaded data to train AI or machine-learning models without explicit written consent. All AI outputs are subject to human review, and processing is limited to the minimum data necessary to deliver the Services. AI-generated outputs are provided for informational purposes and should not be relied upon as the sole basis for business or operational decisions without human review.
Data ownership & sharing
All data uploaded to the platform remains the property of your organisation. By using the Services, you grant Theta Dynamics a limited right to process such data solely for the purpose of providing the agreed Services.
We do not sell or trade personal data. We share it only with trusted sub-processors under strict agreements, with legal authorities when required by law, or as part of a business transfer such as a merger or acquisition.
Data location & transfers
Personal data is stored within the UK (UK South region) using Microsoft Azure (UK South) and Google Cloud Platform (London region). Data is not transferred outside the UK unless appropriate safeguards — such as international data-transfer agreements — are in place.
Security & breach response
- Encryption in transit (TLS 1.2 or higher) and at rest (AES-256).
- Role-based access controls and audit logging.
- In the event of a data breach, we notify the relevant authority within 72 hours and inform affected clients promptly.
While we apply strong technical and organisational measures, no method of transmission or storage is completely secure, and the Services are provided on an “as is” and “as available” basis.
Data retention
We retain personal data only as long as necessary:
- Account & contact data — duration of the contract plus six years.
- Operational data — deleted or returned within 30 days after contract termination.
- Security logs — retained for 12 months.
- Marketing records — kept until consent is withdrawn.
Your rights
Individuals have rights under UK GDPR, including access, rectification, erasure, restriction, portability, and objection to processing. Requests are handled within one month. For queries or complaints, contact our Data Protection Officer at Theta Dynamics Ltd (UK and UAE — Dubai), or email support@thetadynamics.io. You may also lodge a complaint with a supervisory authority such as the UK Information Commissioner’s Office (ICO).
Liability & termination
To the fullest extent permitted by law, Theta Dynamics Ltd shall not be liable for any indirect, incidental, or consequential damages — including loss of profits, data, or business opportunities — arising from use of the platform.
Access may be suspended or terminated if you breach these Terms or misuse the Services. Upon termination, your right to use the platform ceases immediately.
Changes & governing law
We may update these Terms from time to time and will notify clients of significant changes in advance. Continued use of the platform after updates take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the UK courts.
